Sea Burial of Osama bin Laden Breaks Sharia Law, Say Muslim Scholars

US decision to dispose of body in the sea prevents grave site becoming a shrine but clerics warn it may lead to reprisals

Osama bin Laden's burial at sea was quickly criticised by Muslim scholars who claimed it had breached sharia law and warned that it may provoke calls for revenge attacks against US targets.

Others used the sea burial question to question whether he was dead at all, with doubts fuelled by the absence of authentic photographs of his corpse.

US officials said tests using DNA from several of Bin Laden's family members had provided "virtual certainty" that it was his body. A woman believed to be one of Bin Laden's wives identified the al-Qaida leader, and he was visually identified by members of the US raiding party, the Pentagon said. Burying him on land could have led to his grave becoming a focus of contention and pilgrimage as well as posing tough questions about where he should be laid to rest.

"Finding a country willing to accept the remains of the world's most wanted terrorist would have been difficult," a US official said. "So the US decided to bury him at sea." The burial reportedly took place from the deck of the aircraft carrier USS Carl Vinson in the North Arabian sea.

Senior US officials told news agencies that his body was disposed of in accordance with Islamic tradition, which involves ritual washing, shrouding and burial within 24 hours.

The 24-hour rule has not always been applied in the past. For example, the bodies of Uday and Qusay Hussein – sons of the Iraqi dictator Saddam – were embalmed and held for 11 days after they were killed by US forces. Their bodies were later shown to media, provoking some angry responses.

It remains unclear if the US will release photos of Bin Laden's remains, but dispelling any doubts that he is dead is likely to be a major impetus – particularly in an age when conspiracy theories can be powerfully manipulated on the web.

In a hint that such a release may be on the cards, John Brennan, Barack Obama's counter-terrorism adviser said: "We are going to do everything we can to make sure that nobody has any basis to try to deny that we got Osama bin Laden." He added that the US will "share what we can because we want to make sure that not only the American people but the world understand exactly what happened."

Brad Sagarin, a psychologist at Northern Illinois University who studies persuasion, said the rapid disposal of the body "would certainly be a rich sort of kernel for somebody to grasp on to if they were motivated to disbelieve this."

Citing the example of those who refuse to believe that Barack Obama is a US citizen, he added: "As with the birther conspiracy, there's going to be a set of people who are never going to be convinced. People filter the information they receive through their current attitudes, their current perspectives."

Already, doubt is spreading in Pakistan. Many people do not want to believe that Bin Laden is really dead, even though an al-Qaida spokesman, in vowing vengeance against America, called him a martyr, offering no challenge to the US account of his death.

In the immediate aftermath, people in Abbottabad expressed widespread disbelief that Bin Laden had died or ever lived among them.

"I'm not ready to buy Bin Laden was here," said Haris Rasheed, 22, who works in a fast food restaurant. "How come no one knew he was here and why did they bury him so quickly? This is all fake, a drama, and a crude one."

Kamal Khan, 25, who is unemployed, said the official story "looks fishy".

In terms of the basic requirements for Muslim burials, standard practice involves placing the body in a grave with the head pointed toward the holy city of Mecca. Burial at sea is rare in Islam, though Muslim websites say it is permitted in certain circumstances. One is during a long voyage where the body may decompose and pose a health hazard to a ship's passengers, an exception noted on Monday by Tunisian scholar Ahmed al-Gharbi. Another is if there is a risk of enemies digging up a and grave and exhuming or mutilating the body.

Dr Saud al-Fanisan, former dean of the faculty of sharia law in Riyadh, Saudi Arabia, said that if a body was buried at sea it should be protected from fish. In the words of alislam.org, the body should be lowered into the water "in a vessel of clay or with a weight tied to its feet".

Mohammed al-Qubaisi, Dubai's grand mufti, said of Bin Laden's burial: "They can say they buried him at sea, but they cannot say they did it according to Islam. Sea burials are permissible for Muslims in extraordinary circumstances. This is not one of them."

Abdul-Sattar al-Janabi, who preaches at Baghdad's Abu Hanifa mosque, said: "What was done by the Americans is forbidden by Islam and might provoke some Muslims.

"It is not acceptable and it is almost a crime to throw the body of a Muslim man into the sea. The body of Bin Laden should have been handed over to his family to look for a country to bury him."

The radical Lebanon-based cleric Omar Bakri Mohammed said: "The Americans want to humiliate Muslims through this burial, and I don't think this is in the interest of the US administration."

The Egyptian analyst and lawyer Montasser el-Zayat said Bin Laden's sea burial was designed to prevent his grave from becoming a shrine. But an option was an unmarked grave. "They don't want to see him become a symbol," he said. "But he is already a symbol in people's hearts."

Indonesia Clerics Condemn Osama's Sea Burial

Indonesia's top Islamic body on Tuesday condemned the sea burial of Osama bin Laden, as radicals promised a day of mass prayer to mourn the Al-Qaeda leader's death at the hands of US special forces.

President Susilo Bambang Yudhoyono's office issued a statement which neither applauded nor condemned the killing of the world's most wanted terrorist and alleged mastermind of the 9/11 attacks on the United States.

"The president said Indonesia has a common spirit with other nations in fighting against terrorism," spokesman Julian Pasha said in the first official Indonesian reaction to the news.

Indonesia has been hit by multiple terror attacks including the 2002 Bali bombing which killed more than 200 people, mainly Western tourists.

Its US-backed counter-terrorism force has killed and arrested scores of militants since 9/11, including leaders of the Jemaah Islamiyah (JI) regional network who had links to Al-Qaeda.

Police said they were on alert for possible retaliatory attacks. Bali governor Made Mangku Pastika warned: "Osama's followers will not stay silent."

"They're certainly moving and Indonesia will become an easy target, especially Bali because there are close links between Osama bin Laden and the Bali bombings," he said.

Reflecting local sensitivities, the Indonesia Ulema Council (MUI), the country's highest Islamic body, slammed the US decision to bury bin Laden at sea.

"A Muslim, whatever his profession, even a criminal, their rites must be respected. There must be a prayer and the body should be wrapped in white cloth before being buried in the earth, not at sea," MUI chief Amidhan said.

"Many others have condemned it, especially as it was done with extraordinary hatred against him."

The United States says bin Laden received Muslim rites but his body was "eased" into the Arabian Sea so no one could turn his grave into a shrine. Other Muslim leaders have also condemned the method of burial.

While Yudhoyono warily avoided antagonising radicals, liberals expressed relief that bin Laden's career of terror had come to an end.

"Osama's death is not only a win for America but for the world. He was an icon for terrorism and with his death, we hope that the terror network will be weakened," Democratic Party of Struggle legislator Eva Kusuma Sundari said.

But radicals hailed the Al-Qaeda leader as a "martyr" who championed Islam.

A violent vigilante group known as the Islamic Defenders Front announced plans to hold a "mass prayer for bin Laden" on Wednesday. Mourners were invited to "express gratitude to the late martyr Sheikh Osama bin Laden".

The group's Jakarta branch chairman, Habib Salim Alatas, said there was no proof that bin Laden was the mastermind of the September 11, 2001 attacks on New York and Washington that killed around 3,000 people.

"This is a question that must be answered by countries such as Australia, Britain, the United States and the Jews," he told AFP, adding that bin Laden was a "sincere fighter who defended Islam".

A spokesman for Islamist group Jemaah Ansharut Tauhid (JAT) said bin Laden's death was not the end of Al-Qaeda.

"Al-Qaeda didn't die with him. Jihad will not be dampened just because he's dead, because jihad is a command of the religion, not of individuals," he said.

Osama Bin Laden Killed in U.S. Operation Near Islamabad

Al-Qaeda leader Osama bin Laden was killed in Pakistan yesterday in a firefight with a team of U.S. operatives who raided the compound where he had been hiding, President Barack Obama said.

“On nights like this one we can say to those families who have lost loved ones to al-Qaeda’s terror: Justice has been done,” Obama said in a late-night televised address from the White House.

Obama delivered the news to the nation almost 10 years after the Sept. 11 attacks, orchestrated by bin Laden, that killed almost 3,000 people at the World Trade Center in New York, the Pentagon in suburban Washington and a field in Pennsylvania where hijacked United Flight 93 crashed.

Bin Laden had eluded U.S. forces that had invaded Afghanistan following the 2001 attacks on the U.S., escaping across the mountainous border with Pakistan. After years of “painstaking” work, U.S. intelligence last August picked up his trail in Pakistan, Obama said, and after months of investigation he was tracked to a compound in a city north of Islamabad.

“Finally, last week, I determined that we had enough intelligence to take action, and authorized an operation to get Osama bin Laden and bring him to justice,” Obama said.

Obama and his predecessor, former President George W. Bush, made capturing al-Qaeda leader bin Laden a key national security priority.
Targeting Bin Laden

Obama said that shortly after taking office in 2009, he directed Central Intelligence Agency Director Leon Panetta to make the killing or capture of bin Laden the “top priority” in the war against al-Qaeda. In August, Obama was briefed on a possible lead to bin Laden’s location, he said.

The intelligence ultimately revealed that bin Laden was living in a large home in a secure compound in Abbottabad, an affluent suburb of Islamabad, according to administration officials who briefed reporters after Obama spoke.

The officials, who spoke on condition of anonymity to discuss the planning of the raid, said the compound was valued at about $1 million and was built roughly 5 years ago for the purpose of harboring bin Laden.

Housed in an area with many retired military personnel and insulated from natural disasters and local terrorist attacks, the three-story compound sat on a large plot of land with residential homes nearby.
Security Measures

It was roughly eight times larger than other homes in the area with extraordinary security measures including walls towering 12-feet to 18-feet high and topped with barbed wire, the officials said.

Access was restricted by two security gates and the compound residents burned their trash instead of leaving it out for collection like the other homes in the neighborhood. There also were no phone or internet connections, according to the officials.

When they first became aware of it, intelligence officials concluded that there was a high-value al-Qaeda target being harbored and a strong probability that it was bin Laden.

Their conclusions came after years of intelligence gathering, largely from detainees and specifically pursuing leads on personal couriers in bin Laden’s inner circle, officials said.

Officials said they didn’t know for certain how long bin Laden had been living there.
Authorizing Action

The president gave the go ahead for the operation early in the morning of April 29, according to one of the officials.

Officials described a helicopter raid on the compound using what they said was a small team and designed to minimize risk to non-combatants in the compound. At least two helicopters were used; one had mechanical problems.

The operation at the compound lasted less than 40 minutes. Three other adult males were killed in addition to bin Laden, officials said. One woman was killed when she was used as a human shield by a male combatant, the officials said.

Express 24/7, a Lahore, Pakistan-based television station, last night showed video of what it said was compound in Abbottabad in flames. Several Pakistani televisions stations broadcast what they said was a still photograph of bin Laden’s body,with his face smeared with blood and his left eye mutilated.

Abbottabad, a city of about 100,000 people located in hills about 30 miles north of the capital, Islamabad, is the center of a region dominated by army facilities and weapons factories. The city, named for the British colonial officer who founded it, has avoided the terrorist attacks that have struck Lahore, Karachi and other major Pakistani cities.
Intelligence Not Shared

U.S. officials said they didn’t share their intelligence with any other country, including Pakistan, and only a small group of people in the government knew the plans.

“Tonight we are once again reminded that America can do whatever we set our mind to,” Obama, 49, said. “That is the story of our history.”

Obama warned that the fight against terrorism isn’t ended with the death of bin Laden.

“There’s no doubt that al-Qaeda will continue to pursue attacks against us,” he said.

The State Department issued an alert to U.S. citizens traveling abroad to warn of potential anti-American violence as a result of the raid.

Even before Obama spoke, a cheering, chanting crowd gathered outside the north gates of the White House as news of bin Laden’s death spread. The throng of people continued to grow after midnight along Pennsylvania Avenue.
Proud

“It’s been 10 years, it’s really a rallying point that we’ve been successful with what we’ve been doing abroad,” said Glen Dalakian, 21, a student at American University, who was among those gathered in front of the White House this morning. “It makes you proud to be an American waving the flag once again.”

Obama called Bush to inform him about the raid.

“I congratulated him and the men and women of our military and intelligence communities who devoted their lives to this mission,” the former president said in a statement. “This momentous achievement marks a victory for America, for people who seek peace around the world, and for all those who lost loved ones on Sept. 11, 2001.”

The administration briefed congressional officials ahead of the president’s address.
‘Great Relief’

House Speaker John Boehner, an Ohio Republican, said he wanted to “commend President Obama and his team, as well as President Bush, for all of their efforts to bring Osama bin Laden to justice.”

"The news that Osama Bin Laden is dead will bring great relief to people across the world,’’ U.K Prime Minister David Cameron said in a statement congratulating Obama and the U.S. personnel who conducted the raid.

“Osama Bin Laden was responsible for the worst terrorist atrocities the world has seen -- for 9/11 and for so many attacks, which have cost thousands of lives, many of them British,” Cameron said in an e-mail statement. “It is a great success that he has been found and will no longer be able to pursue his campaign of global terror.”

Foto Wajah Jenazah 'Osama' Muncul di Internet

Presiden AS Barack Obama telah memastikan kematian pemimpin jaringan Al Qaeda, Osama bin Laden. Sesaat setelah berita kematiannya menyebar, foto wajah jenazah 'Osama' pun langsung menyeruak di internet.

Berdasarkan pantauan detikINET, Senin (2/5/2011), di beberapa halaman Facebook bernama 'Osama bin Laden Dead' foto wajah jenazah yang diduga Osama tersebut tampak begitu diminati para pengguna.

Belum jelas apakah foto ini asli atau tidak. Namun sekilas ketika diamati foto tersebut terlihat bercak darah yang natural serta bekas tembakan tepat di kepala. Hanya saja, di bagian mata dan sobekan baju tubuhnya terlihat tidak natural.

Sebelumnya diberitakan pemimpin jaringan Al Qaeda itu tewas dalam serangan pasukan AS di Pakistan. Osama tewas setelah ditembak di bagian kepala.

Hal itu disampaikan pejabat-pejabat AS kepada stasiun televisi NBC. Dikatakan pejabat-pejabat yang enggan disebutkan namanya itu, pasukan Operasi Khusus AS melancarkan serangan terhadap sebuah bangunan di luar Islamabad, Pakistan.

Dalam pertempuran yang terjadi Minggu, 1 Mei itu, personel AS melepaskan tembakan yang mengenai kepala Osama. Dia pun tewas dalam kontak senjata itu.

Serangan pasukan AS yang menewaskan Osama bin Laden di Pakistan juga menewaskan empat orang lainnya. Keempat orang itu terdiri dari tiga pria dan seorang wanita. Salah satu korban tewas diyakini sebagai putra Osama.

"Selain Osama bin Laden, tiga pria dewasa juga tewas dalam serangan itu," ujar seorang pejabat AS kepada para wartawan di Washington seperti dilansir kantor berita AFP, Senin (2/5/2011).

Menurut pejabat yang enggan disebutkan namanya itu, dua pria tersebut bekerja sebagai kurir kepercayaan bagi Osama sedangkan pria ketiga diyakini sebagai putra Osama. Namun tidak disebutkan nama putra Osama tersebut.

"Seorang wanita tewas saat dia digunakan sebagai tameng oleh seorang pejuang pria. Dua wanita lainnya terluka," imbuh pejabat tersebut.

Osama tewas dalam serangan pasukan khusus AS yang dilancarkan terhadap sebuah rumah besar di luar Islamabad, Pakistan pada Minggu, 1 Mei. Tewasnya pemimpin teroris asal Arab Saudi itu telah diumumkan langsung oleh Presiden AS Barack Obama dalam pidatonya di Gedung Putih.

Wajah Osama Berlumuran Darah
Beberapa televisi Pakistan mengeluarkan tayangan wajah Osama bin Laden yang berlumuran darah setelah Pemerintah AS mengumumkan gembong jaringan Al Qaeda ini tewas terbunuh.

"Tayangan gambar jenazah Osama bin Laden telah dipublikasikan. Belum ada verifikasi dari tayangan itu," kata komentator jaringan televisi terkemuka di Pakistan, Geo.

Beberapa jaringan televisi menayangkan gambar sosok wajah berjanggut tebal berwarna hitam tanpa terlihat warna keputih-keputihan seperti tayangan video yang pernah beredar dan memperlihatkan warna janggut Osama bin Laden semasa ia hidup.

Noda darah terlihat pada bagian kening dan pelipis bagian kirinya. Mata bagian kanannya tertutup, sementara bagian putih dari mata sebelah kirinya masih terlihat dalam tayangan televisi. Mulutnya sedikit terbuka sehingga memperlihatkan bagian giginya.(*)

TNI Tembak 4 Perompak Somalia

DPR mengapresiasi operasi militer TNI yang menewaskan empat orang perompak Somalia. DPR segera menambah dana dan peralatan militer untuk TNI.

"Ini baru tentara kita, itu harus diapresiasi, kami baru angkat topi. Nggak salah kemarin kita meneken sekian triliun dana untuk TNI kalau perlu kita naikkan dana mereka, kita tambahin alat perang mereka kalau perlu," ujar Wakil Ketua DPR, Priyo Budi Santoso, bangga.

Hal ini disampaikan Priyo kepada wartawan di Gedung DPR, Senayan, Jakarta, Senin (2/5/2011).

Priyo menuturkan sebetulnya pasukan TNI memiliki kualitas yang kompetitif. Namun selama ini TNI kurang menunjukkan kelasnya.

"Sebenarnya Kopassus, Kopaska, dan Marinir ini terlatih juga. Kali-kali Indonesia perlu menunjukkan ke mata dunia," papar Priyo.

Ke depan ia berharap operasi militer lebih diutamakan. Sehingga kapal Indonesia tidak menjadi langganan perompak Somalia.

"Saya tidak sreg dengan pemberian tebusan. Tapi yang penting selamat sudah selamat sanderanya. Ke depan operasi intelijen saja diam-diam. Kapal dagang kita harus dikawal oleh tentara. Sekaligus latihan untuk TNI kita," imbaunya.(van/anw)
